Percipient Financial Inc. ("Percipient" or "we") is committed to maintaining the accuracy, confidentiality and security of Personal Information in accordance with applicable legislation. This privacy policy (the "Privacy Policy") is a statement of the principles and guidelines concerning the protection of the Personal Information of Percipient's clients, service providers or other individuals ("you").

The term "Personal Information" when used in this Privacy Policy means information about an identifiable individual, for example, a person's name, age, home address or telephone number. Personal Information does not include business contact information, which is information that would allow a person to be contacted at their place of business such as a person's name, title, position, business telephone number, fax, email or address. Business contact information is not covered in this Privacy Policy.

Your Consent

By submitting any Personal Information to Percipient or its service providers or agents, you agree that (i) we may collect, use and disclose such Personal Information in accordance with this Privacy Policy; and (ii) you or your representatives are authorized to provide us with the Personal Information. If you do not agree with the terms of this Privacy Policy, do not provide Percipient with any Personal Information.

Certain services can only be offered if you provide Percipient with Personal Information. Consequently, if you choose not to provide us with any required Personal Information, we may not be able to offer you certain services.

The Types of Personal Information We Collect

The types of Personal Information that Percipient collects from you depends upon the situation and the nature of the services that we provide you.

If you are a Percipient merchant, we will collect Personal Information from you such as contact information, banking information and billing information, including credit card information, as applicable. If you are a Percipient end-user, we will collect Personal Information from you such as contact information, name, email address, account information, credit card number and related information, as applicable. If required to provide a service to you or respond to a question by you, we may collect Personal Information regarding you or your end-user customer, as applicable, such as the stored value card number, name, address, email address, telephone number, and transaction details or history, as applicable. We may collect details regarding your transaction history and services with Percipient. If you apply for a job with Percipient, we will collect Personal Information such as your resume and may collect further Personal Information regarding your application.

When you view the Percipient website, we use a website analysis program to obtain information such as the number of people who view the website, what pages of our website they visit, and what websites they came from. This information is used by us solely to access the effectiveness of our website. We may also use web server logs to tell us the referring URL's that you came from. This is used to aid us in preventing and analyzing patterns of fraudulent behavior.

If you are a Percipient customer and use a login id on our website, cookies are used as sessions id's to assist in site navigation.

Statistical information is collected and used on an aggregate basis. No Personal Information is associated with these statistics. This statistical information is used to help us to continue to provide the best services to our customers.

Why We Collect Your Personal Information

We understand that your Personal Information may be private, and therefore we only collect it for the following purposes:

To establish your requested services.

For example, if you contact us to sign up for a service, we will collect Personal Information from you in order to set up the requested service and to establish the billing arrangement.

To maintain your services.

For example, we may collect Personal Information about you or your end-user customer, as applicable, in order to provide you with your requested services, or if you have a question or require assistance with a particular transaction or service, we may collect Personal Information about you or your end-user customer, as applicable, in order to address the issue at hand or to verify your identity.

To provide you with ongoing information.

For example, we may provide you with bulletins or updates regarding new services or features.

To run contests and other promotional activities.

For example, we may collect information regarding your transaction activity and/or history for entry in a contest and/or to notify you of your potential winning of a contest with Percipient.

To better understand and meet the needs of our customers.

For example, we may collect information regarding your product or transaction histories with Percipient.

To find new employees.

For example, if you apply for a job at Percipient, we will collect your resume and possibly other Personal Information related to your application or interview.

When We May Disclose Your Personal Information

At Percipient we do not sell or rent your Personal Information. Personal Information that you provide us with may be disclosed to merchants, payment processors, financial institutions or other third parties only when such parties require the Personal Information to process your transactions.

Further, we may disclose your Personal Information when we are required to do so by law, such as pursuant to a court order, or when we are permitted to do so by law, such as in the collection of debts.

How We Store and Safeguard Your Personal Information

Percipient is committed to the protection and security of your Personal Information. Our security practices are reviewed on a regular basis and we employ current industry standard technologies to ensure the security of your Personal Information.

Electronic information is stored on secure servers maintained in a secure environment with limited access. Paper files are stored in locked filing cabinets and locked offices with limited access. When destroyed, paper files are shredded and electronically stored information is deleted.

Employees at Percipient are not provided with general access to Personal Information. Employees only have access to Personal Information if such access is necessary for the performance of their job. Further, all employees at Percipient are informed about the importance of security and Percipient's security practices.

Information provided to us over our websites is encrypted and protected with Secure Socket Layer (SSL) and encryption technologies.

How You Can Access or Amend Your Personal Information

You have the right to access your Personal Information that is held by Percipient, subject to certain exceptions set out by law. These exceptions in which Percipient is not required to provide you with access to your Personal Information include, but are not limited to, situations where the Personal Information is protected by solicitor-client privilege, the Personal Information is commercially sensitive, or the disclosure of the Personal Information would reveal Personal Information about another individual.

If you would like to access your Personal Information, please make a written request to Percipient's Privacy Officer at privacy@onelesscard.com. Please provide us with specific details of the information you are seeking. We may require further information to verify your identity for the request. We may charge you a minimal fee for providing the personal information, in which case we will first advise you of the fee and confirm if we should proceed with the request.

If you would like to amend your Personal Information, please provide the amended information to Percipient's Privacy Officer at privacy@onelesscard.com.

Changes to this Privacy Policy

Percipient reserves the right to change this Privacy Policy at any time and from time to time. If we do change this Privacy Policy, we will post the changes on our website.
